Terms.

for the heartnote app · 27 October 2026 · the German version (Nutzungsbedingungen) is the binding one

1. What this is

heartnote is an app for collecting, rating and sharing your perfumes with friends. It's provided by:

Phil Spaeth
Cecilienstr. 12
66111 Saarbrücken, Germany
Email: hi@byphil.me

These terms apply once you create an account. How we handle your data is in the privacy policy. The app as downloaded from the App Store is also covered by Apple's standard End User License Agreement (EULA). Apple isn't a party to these terms and isn't responsible for heartnote.

2. Who can use heartnote

You must be at least 16. One account per person. Your @handle and display name must not be offensive or pretend you're someone else, such as a brand or a well-known person.

3. What heartnote costs and does

heartnote is free. We keep developing it and may change, add or remove features. We work to keep it running reliably, but can't promise it's always available.

The perfume catalog is maintained by the community and reviewed by us, but it can still contain mistakes. Reference prices are approximate and dated, not offers. "Cost per wear" and your collection's value are rough calculations with no guarantee.

If paid features come later (for example a subscription through the App Store), we'll tell you first, and they'll have their own terms you accept separately.

4. Your content

Content is everything you add or upload: perfumes, brands, bottle sizes, barcodes, photos, ratings, notes and reports. You're responsible for your content. Only upload photos you took yourself or have the rights to, and no photos where other people can be recognised.

4.1 What you allow us to do

You keep the rights to your content. For catalog contributions (perfumes, brands, sizes, barcodes and photos), you give us a non-exclusive, free, worldwide and unlimited right to store them, edit them for the app (for example crop, cut out, resize, standardise spellings, merge entries) and show them to everyone in heartnote and on heartnote.app. This right continues if you delete your account, so the catalog stays complete. We don't name you as the author, as far as you can waive that.

Your personal content (shelf, ratings, notes, wear log) is only used to run the app for you and the people you share it with, and anonymously for community scores. It's deleted with your account.

5. House rules

Not allowed in heartnote:

6. Reporting and moderation

You can report content and people that break these rules or the law in the app, or by email to hi@byphil.me. People you report aren't told who reported them.

We review reports and new catalog contributions, and may decline or remove content and suspend accounts for serious or repeated violations. If we decline or remove something of yours or suspend your account, the app shows you why. A suspended account can still export its data and delete itself. If you think a decision is wrong, email hi@byphil.me and we'll look at it again.

7. Deleting your account and ending use

You can delete your account in the app at any time, which ends your use of heartnote. We can end it with two weeks' notice, for example if we shut heartnote down, and immediately if you seriously break these terms.

8. Liability

We're fully liable for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we're only liable for breaching an essential obligation you can rely on, and then limited to typical, foreseeable damage. Otherwise liability is excluded. For other users' content we're liable as the law provides, in particular once we learn that something is illegal.

9. Changes to these terms

If we change these terms, we'll tell you in the app first. Changes that significantly limit your rights only apply once you agree to them. If you don't agree, you can delete your account at any time.

10. Law and disputes

German law applies. If you're a consumer living in another EU country, the mandatory protections of your country still apply. We're not obliged and not willing to take part in dispute resolution before a consumer arbitration board. If something's wrong, just write to us.
